What Is Gestational Surrogacy?
Gestational surrogacy is when parents use a third party to carry a child that is biologically theirs. This is possible through assisted reproductive technology. But these are complicated situations that require considerable legal assistance.
At Nilson Brand Law, we work hard for our clients with significant reproductive challenges in Fargo and across North Dakota. As gestational surrogacy attorneys, we provide legal support during an emotionally draining experience. Engaging the assistance of a gestational surrogate is not easy, and there are many questions to answer.
Gestational Surrogacy Is Different From Biological Surrogacy
Here, we will refer to a “gestational carrier” by that term because there is a difference between that and a biological surrogate. Gestational carriers give birth to children who are not related to them biologically. A biological surrogate provides the egg and carries the baby to term. However, gestational carriers can get a gestational carrier agreement (GCA), an enforceable contract for the birth, but biological surrogates cannot.
A Brief Overview Of The Gestational Carrier Process
If you’re committed to engaging the services of a gestational carrier, we can help. We’ve had extensive experience helping people in Fargo pursue this option. Below are the basic steps.
Identify The Gestational Carrier
Most parents have a gestational carrier in mind when they choose this path – often a close friend or family member. However, that’s not always the case, and there are agencies that help people find someone willing to help.
Negotiate A Gestational Carrier Agreement
The unique aspects of the contract will also dictate how family members receive the child. Will they be allowed in the delivery room? Will the surrogate want to go to the hospital alone? How long after the birth will the child stay with the surrogate? These questions will have to be answered.
Secure A Pre-Birth Order From The Court
Midway through the pregnancy, you and your lawyer will compile the necessary documentation to get a pre-birth order. This order will explain to the hospital who the legal parents of the child are and how to fill out the vital documents at birth.
Get Documentation Finalization At The Delivery
Once the child is born – with the pre-birth order in the hands of the hospital – the staff will fill out the important forms, and you will be able to take your newborn child home.
We Are Gestational Surrogacy Attorneys Who Look Out For Our Clients
We work with prospective parents and gestational carriers and look after our clients’ interests from beginning to end. The gestational carrier agreement is a contract, and both sides should benefit from the contract. Our work is to ensure that happens.
