Mistakes to avoid if pulled over for DUI

On Behalf of | Oct 28, 2024 | DUI

Getting pulled over for a DUI can be a stressful experience, and your actions in those moments can significantly impact the outcome.

Here are key mistakes to avoid if you find yourself in this situation.

Talking too much or admitting fault

It’s essential to stay calm and polite but avoid giving unnecessary information or admitting to drinking. Anything you say can be used against you in court. Stick to basic information like your name and hand over your driver’s license, registration, and insurance.

Refusing to comply with the officer’s instructions

While protecting your rights is crucial, outright refusal to cooperate with reasonable instructions may escalate the situation. Declining to take a field sobriety test or provide identification could lead to further legal complications, including arrest.

Taking field sobriety tests without knowing your rights

You are not legally obligated to perform field sobriety tests in most states, as they are subjective and often difficult to pass, even when sober. Politely decline these tests if you believe they will not reflect your condition. However, be aware that refusal might still raise suspicion.

Arguing with the officer

Arguing or being confrontational will not help your case. Even if you feel you are being treated unfairly, it is better to remain respectful and cooperative. You will have the opportunity to contest the stop in court later.

Not requesting access to a lawyer after being arrested

If you are arrested, avoid making statements or explanations until you consult an attorney. Contacting a lawyer immediately protects your rights and helps you avoid further incriminating yourself.

By staying calm and following these tips, you can minimize the legal risks and better navigate a DUI stop.
